Overview

PERM stands for Program Electronic Review Management. This is also known as PERM labor certification. For many foreign workers seeking permanent residency in the United States, the PERM Labor Certification process is the first step. It is a determination and certification by the Department of Labor (DOL) that there are not sufficient workers who are able, willing, or equally qualified to do the work needed, and the employment of aliens will not adversely affect the wages and working conditions of the workers in the U.S. similarly employed.

In brief, the PERM process requires the petitioning employer to conduct a series of recruitment activities to test the labor market before filing the application. If sufficient able, qualified, and willing applicants are not found for a position through the recruitment process, the employer can submit a PERM labor certification application.

After PERM labor certification is approved by the DOL, an Immigrant Petition related to the labor certification should be filed with the USCIS before the expiration of the labor certification. The certification has a validity period of 180-days and expires if not submitted to USCIS within this period.

Outline of a Typical PERM Case Progression

  1. Employee, with Manager's assistance, forwards to Attorney information necessary to begin the case.
  2. Attorney performs legal analysis and develops case plan.
  3. Attorney consults with Employee and Manager until Company approves a final job description.
  4. Attorney files Prevailing Wage Determination application with the DOL.
  5. Attorney completes PERM Recruitment Schedule and issues instructions to place advertisements.
  6. Company runs recruitment and provides results to Attorney.
  7. Throughout the recruitment process Company may communicate with Attorney to clarity questions that may arise.
  8. Attorney reviews all recruitment documentation and drafts a recruitment report based on information provided by Company.
  9. Attorney completes and files the PERM application online with the DOL.
  10. Attorney follows up and responds to DOL requests until case is approved.

Main Qualifying Criteria

  • The employer must hire the foreign worker as a full-time employee;
  • There must be a bona fide job opening;
  • Job requirements must adhere to what is customarily required for the occupation in the U.S. and may not be tailored to the worker's qualifications. In addition, the employer shall document that the job opportunity has been and is being described without unduly restrictive job requirements, unless adequately documented as arising from business necessity.
  • The employer must pay at least the prevailing wage for the occupation in the area of intended employment.

  • Prevailing Wage

    Prior to filing the Application for Permanent Employment Certification, ETA Form 9089, the employer must request a prevailing wage (PW) determination from the Department of Labor. The employer is required to include on the ETA Form 9089 the following PW information: the prevailing wage, the prevailing wage tracking number (if applicable), the SOC/O*NET(OES) code, the occupation title, the OES skill level (if applicable), the wage source, the determination date, and the expiration date. The prevailing wage determination documentation is not submitted with the application for permanent labor certification, but must be retained for a period of five years from the date of filing the application by the employer. This documentation must be submitted if requested by the Certifying Officer during an audit.

    Determining the appropriate wage level depends on a full consideration of the experience, education, and skills required by the employer as indicators of the complexity of the job duties, the level of judgment required and the amount of supervision involved. A prevailing wage determination has a limited validity period. The validity period may range from 90 days to no more than one year from the determination date.

  • PERM Advertising and Recruitment for Professional Positions

    For professional positions, the employer must recruit under the standards for professional occupations set forth in 20 CFR 656.17(e)(1)

The universal requirements are:

  1. Job Order placed with SWA for 30 days;
  2. Two Sunday print ads must be placed in a newspaper of general circulation in the geographic area of the proposed place of employment. Employers may substitute one national journal ad for one newspaper ad where the position requires experience and/or an advanced degree;
  3. Post an internal job posting with all required information by the DOL for a period of 10 consecutive business days; or give proper notice to bargaining representative if the position is a union position.

Three additional recruitment steps must be carried out for "professional positions" - employers may submit documentation of any three of the following types of recruitment activities:

  1. Employer's website ads
  2. Job search website
  3. Job fair
  4. On-campus recruiting
  5. Trade or professional organizations
  6. Private employment firms
  7. Employee referral program with incentives
  8. Campus placement offices
  9. Local and ethnic newspapers
  10. Radio and television ads
  • Recruitment Report and Record Retention Requirement

    Employers are required to maintain documentation of the recruitment efforts and the results thereof, including the lawful job-related reasons for rejecting any U.S. workers who applied for the job, but the documentation does not need to be submitted with the application. Employers are required to retain documentation of recruitment efforts for five years, measured from the date on which the application for labor certification is filed with DOL.

    The employer must sign a report describing the recruitment steps undertaken and the results achieved, the number of hires, and if applicable, the number of U.S. workers rejected, and the lawful job related reasons for such rejections. Note that U.S. workers who can acquire the required skills in a reasonable period of on-the-job training cannot be lawfully rejected. Resumes and other documentation must also be maintained. In the event of an audit, the Certifying Officer may request the U.S. workers’ resumes or applications, sorted by reasons the workers were rejected.

  • PERM Audit

    If an application is selected for audit, the employer will receive an audit letter specifying additional documents within 30 days. The Certifying Officer may grant one extension up to 30 days from the initial 30 period in which to respond to the audit letter. If DOL determines that the documentation is complete and consistent with responses on the ETA 9089, it will certify the application. If the documentation is deemed deficient by the DOL, the certification may be denied. Alternatively, the Certifying Officer may request additional documentation or order supervised recruitment. DOL has indicated that an application cannot be withdrawn once it has been selected for audit. If an application is selected for audit, the employer cannot forego the audit by claiming the application is no longer valid or applicable.

    The supervised recruitment under PERM requires the placement of advertisements in conjunction with a 30-day job order. At the completion of supervised recruitment, the employer has 30 days to document in a recruitment report the outcome of the effort, and the lawful job-related reasons for not hiring any U.S. worker applicants. Upon receipt of the employer’s recruitment report, the Certifying Officer will either certify or deny the application.

Overview

The O-1 visa is a non-immigrant employment-based visa classification for foreign nationals who can demonstrate sustained national or international acclaim and recognition for achievements in the science, education, business or athletics. It requires the employer file a Petition for a Nonimmigrant Worker (Form I-129), along with evidence of the individual’s extraordinary ability. The standards of “extraordinary ability” are virtually identical to those applicable to employment-based EB-1 category for aliens of extraordinary ability.

Main Qualifying Criteria

The O-1 petition requires employer sponsorship. The employment must be in a capacity that requires the extraordinary ability. A written consultation/advisory opinion must be submitted, from a peer group, or recognized expert, in the field in the individual's area of ability, along with evidence to prove the alien’s extraordinary ability.

For Aliens in the sciences, education, business, and athletics:

Applicant can show evidence of receiving a major, internationally recognized award such as a Nobel Prize. In absence of that, one can establish his qualifications through at least three of the following types of evidence:

  1. Documentation of receipt of lesser nationally (not necessarily U.S.) or internationally recognized prizes or awards for excellence in the field of endeavor;
  2. Documentation of membership in associations in the field of endeavor which require outstanding achievements of their members, as judged by recognized national or international experts in their fields;
  3. Published material in professional or major trade publication or in the major media about the alien and relating to the alien's work in the field of endeavor;
  4. Evidence of participation as a judge (individually or as a part of a panel) of the work of others in the alien's field;
  5. Evidence of scientific, scholarly, or business related contributions of major significance in the field of endeavor;
  6. Evidence of authorship of scholarly articles in the field, in professional journals or other major media;
  7. Evidence of performance in a critical or essential capacity for organizations or establishments with distinguished reputations;
  8. Evidence of having commanded a high salary or other significantly high remuneration for services in relation to others; and
  9. Other comparable evidence.

For Aliens in the arts, motion pictures, or television:

For arts, applicant must show that he has acquired "distinction" in his artistic field. Persons in the motion picture or television industry must show a very high level of accomplishment evidenced by a degree of skill and recognition significantly above that ordinarily encountered to the extent that the person is recognized as outstanding, notable, or leading in the industry. In either case, Applicant can show evidence of receiving a major, internationally recognized award such as an Academy Award, an Emmy, a Grammy, or a Director's Guild Award. In absence of that, one can establish his qualifications through at least three of the following types of evidence:

  1. Having been or will be performing a lead or starring role in productions or events which have a distinguished reputation (as evidenced by critical reviews, advertisements, press releases, publications contracts, or endorsements;
  2. Critical reviews or other published material in professional or major trade publication or in the major media by or about the alien which show that the alien has achieved national or international recognition or achievements;
  3. Evidence of performance in a lead, starring or critical role for organizations or establishments with distinguished reputations;
  4. Evidence of a record of major commercial or critically acclaimed successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales;
  5. Evidence of significant recognition for achievements form organizations, government agencies, or other recognized experts in the field;
  6. Evidence of having commanded a high salary or other significantly high remuneration for services in relation to others; and
  7. Other comparable evidence

Documents Typically Needed

The types of supporting documents vary depending on the applicant’s field. The following is a list for a scientist case:

  • Written consultation
  • Copy of employment contract
  • Copies of published journal articles or book chapters; if possible, collect evidence to prove the ranking of the journal
  • Copies of documentation regarding any patents which you may hold
  • Documentation of award or prize received
  • Evidence of citations of your articles
  • Documentation of peer-reviewed presentations
  • Evidence of invitations you may have received to participate in conferences, submit papers or to review work of other scientists, including documentation of participation as a reviewer, judge, on a panel or individually of work of others in the same field

Overview

Established by the Immigration Act of 1990 (IMMACT), the H-1B nonimmigrant visa category allows U.S. employers to augment the existing labor force with highly skilled temporary workers. H-1B workers are admitted to the United States for an initial period of three years, which may be extended for an additional three years. The H1B visa program is utilized by businesses and organizations to employ foreign workers in specialty occupations that require theoretical or technical expertise in a specialized field.

Specialty occupation is defined as: "an occupation that requires (a) theoretical and practical application of a body of highly specialized knowledge, and (b) attainment of a bachelor’s or higher degree in the specific specialty (or its equivalent) as a minimum for entry into the occupation in the United States" [INA§214(i)(1), 8 USC § 1184(i)(1)]. Typical H-1B occupations include architects, engineers, computer programmers, accountants, doctors and college professors. The current annual cap on the H1B category is 65,000.

The H1B Visa Reform Act of 2004, which took effect on May 5, 2005, changed the H1B filing procedures for FY 2005 and for future fiscal years. The Act also makes available 20,000 new H1B visas for foreign workers with a master’s or higher level degree from a U.S. academic institution.

Spouse and unmarried children under 21 years of age of H1B workers are entitled to H-4 status with the same restrictions as the principal.

Main Qualifying Criteria

The H1B program allows an employer to temporarily employ a foreign worker in the U.S. on a nonimmigrant basis in a specialty occupation. H1B is job-specific. This means that the foreign professional must have a job offer from an U.S. employer, and the position offered must require the worker's qualifications and/or skills.

Specialty Occupation

The position offered must qualify as a specialty occupation. A specialty occupation requires the theoretical and practical application of a body of specialized knowledge and a bachelor's degree or the equivalent in the specific specialty (e.g., engineering, mathematics, physical sciences, computer sciences, medicine and health care, education, biotechnology, and business specialties, etc.).

Educational Qualifications

To qualify for the H1B visa category, the prospective H1B employee must hold a U.S. bachelor's or higher degree, or the equivalent. USCIS holds "equivalent" to mean "the achievement of a level of knowledge, competence, and practice in the specialty occupation that has been determined to be equal to that of an individual who has a baccalaureate or higher degree in the specialty occupation. Three years of employment in progressively more responsible positions in the specialty occupation are considered by USCIS as equivalent to one year of academic training.

An applicant without a U.S. bachelor's degree must demonstrate that he has the equivalent to this degree to qualify for the H-1B category.

In addition to the academic qualifications, the individual must be fully qualified to lawfully perform the duties of the position offered. In occupations that require licensure or professional credentials (e.g., doctor, dentist, attorney, CPA, architect, registered nurse), the individual must already hold such qualification before the H1B visa petition can be filed.

Employer’s responsibilities

Each employer seeking an H1B nonimmigrant in a specialty occupation has several responsibilities:

The employer shall submit a completed Labor Condition Application (LCA) on Form ETA 9035E in the manner prescribed by the regulations. By completing and signing the LCA, the employer agrees to several attestations regarding an employer's responsibilities, including the wages, working conditions, and benefits to be provided to the H1B nonimmigrant.

The employer shall make the LCA and necessary supporting documentation available for public examination at the employer’s principal place of business in the U.S. or the place of employment within one working day after the date on which the LCA is filed with ETA.

The employer may then submit a copy of the approved LCA to USCIS with a completed petition (USCIS Form I-129) requesting H1B classification.

The employer shall not allow the nonimmigrant worker to begin work until USCIS grants the worker authorization to work in the U.S. for that employer or, in the case of a nonimmigrant who is already in H1B status and is changing employment, to another H1B employer until the new employer files a petition supported by a certified LCA.

The employer shall maintain documentation to meet its burden of proof with respect to the validity of the statements made in its LCA and the accuracy of information provided, in the event that such statement or information is challenged. The employer shall also maintain such documentation at its principal place of business in the U.S. and shall make such documentation available to DOL for inspection and copying upon request.

Quota Issues

The Immigration and Naturalization Act ("INA") allows for the issuance of only a specific number of each type of visa, both immigrant and nonimmigrant, every fiscal (October 1st to September 30th) year. Once this visa "cap" is reached, no more visas can be issued until the beginning of the next fiscal year.

In 1990 Congress imposed a numerical cap on the number of H1B visas issued each fiscal year. The first cap set H1B numbers at 65,000 annually. In the thriving economy of the late 1990s, the cap was prematurely reached in FY 1997, FY 1998, FY 1999, and FY 2000. Once a fiscal year's cap was reached all additional H-1B petitions were returned until a new fiscal year began, thus causing significant strain on U.S. businesses. To alleviate this problem, Congress raised the fiscal year cap to 115,000 for FY 1999 and FY 2000, and then to 195,000 for FY 2001-2003. The temporary increase ended. Effective October 1, 2003, only 65,000 new H1B petitions can be granted each year.

Quota exemptions: Not all H1B visa petitions are subject to the cap, however. Examples of "exempt" categories include: H1Bs hired by institutions of higher learning, affiliated research organizations, nonprofit research organizations and governmental research organizations.

Also, if the individual was in the U.S. in H1B status, s/he is not subject to the quota, since AC21 section 103 amends INA section 214(g)(7) to make clear that anyone who already has been counted in the past six years would not be counted again unless eligible for another full six years.

The Consolidated Appropriations Act of 2005 was enacted on December 8, 2004. The Act provides new exemptions from the annual H1B cap: the first 20,000 H1B beneficiaries who have earned a master's degree or higher from a U.S. institution of higher education are not subject to the annual H1B cap.

Who is affected by the cap: Given that the H1B cap returned to 65,000 on October 1, 2003, managers, recruiters, and human resource departments planning to hire a foreign national should be concerned about the H1B quota. Additionally, foreign nationals in nonimmigrant status such as B, F, J or H-4 who request a change of status to H1B are also affected by the H1B quota.

Who is not affected by the cap: Foreign nationals currently in H1B status who need to file an extension of status or change of employer are not affected by the drop in H1B numbers. Further, foreign nationals seeking employment through institutions of higher education, nonprofit research organizations, and government research organizations will continue to be exempt from the H-1B cap.

What to do: Plan ahead. Accelerate your H1B filings: current processing times for H1B classification take several days (through Premium Processing) to several months. File as early as possible in the fiscal year.

In short, applicants for National Interest Waiver ("NIW") must show that if they are granted permanent residence, their work will substantially and prospectively benefit the economy, culture, or educational interest or welfare of the U.S. CIS has set forth the general factors which will be considered in connection with a National Interest Waiver application. These factors include whether granting the waiver will:

  1. Improve the US economy;
  2. Improve wages and/or working conditions for US workers;
  3. Improve health care;
  4. Improve education or training programs for US children and under-qualified workers;
  5. Provide more affordable housing;
  6. Improve the environment and assist with the conservation of natural resources;
  7. Upon request of an interested government agency.

At the end of the 2016, the Administrative Appeals Office (AAO) published a precedent decision, Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016). In this case, the AAO has significantly revised the analytical framework for evaluating National Interest Waiver (NIW)-based immigrant visa petitions that had been established in 1998 in Matter of New York State Dep’t of Transportation (NYSDOT).

Matter of Dhanasar established a new 3-pront test: USCIS may grant a national interest waiver if the petitioner demonstrates by a preponderance of the evidence: (1) that the foreign national’s proposed endeavor has substantial merit and national importance; (2) that the foreign national is well positioned to advance the proposed endeavor; and (3) that, on balance, it would be beneficial to the United States to waive the labor certification requirement.
